This issue, due to its complexity and the involvement of multiple elements, has various legal dimensions and aspects, and can be viewed from different angles. In a general overview and in terms of the legal rights that have been violated by the unfaithfulness of Kourosh Company, as well as the significant disruption caused in the country’s economic system, this matter can be considered to have both civil and criminal aspects. The civil aspect refers to the fact that, like any sales contract in which the seller is obligated to deliver the goods in the agreed upon quality and time, the buyer can file a lawsuit and demand the fulfillment of the contractual obligations, as well as compensation for damages incurred, including damages caused by delays in fulfilling the obligations, from the general court of law. Taking into account all aspects and considering that the judiciary has also started criminal prosecution of company managers on charges of fraud, therefore, the current plan of filing a criminal complaint against the company and its managers is a path that will quickly and with less cost lead to compensation for the victims. However, it should be noted that the issuance of a verdict by the judiciary to convict the company and its managers and confiscate their assets will only be beneficial for the victims if the assets of the company and its managers can be identified and seized through a court order, and the lost funds can be returned to them. In other words, even if the managers of the company are arrested and detained, the verdicts issued by the judicial authorities will not have any tangible result for the victims if the assets of the company and its managers cannot be identified.

Therefore, according to paragraph (p) of Article 126 of the Islamic Penal Code, anyone who facilitates the commission of a crime is considered an accomplice and may be subject to criminal prosecution. However, according to the same article’s note, in order to establish complicity in a crime, there must be unity of intention between the accomplice and the perpetrator – meaning that the person who facilitated the commission of the crime must have been aware of the criminal intent and malice of
