Arresting Dual Citizens for Obtaining Points from the West / Mohammad Moghimi

Experience has shown that the Islamic Republic, when faced with crises in the diplomatic and foreign policy arena, uses the detention and accusation of dual citizens as a tool to gain points from the West. One of the most important of these points is the exchange of prisoners. For example, on the eve of Donald Trump’s decision to withdraw from the nuclear deal (JCPOA), the detention of dual citizens was carried out for this purpose, or Mr. Zarif had stated that if Mr. Trump shows goodwill, Iran can consider the issue of dual citizens as one of the negotiation topics. This proposal by the Minister of Foreign Affairs of the Islamic Republic is the strongest evidence that this regime intends to use these individuals in political negotiations and bargaining. In fact, these individuals have not committed any crime for which they should be punished, and if they have committed a crime, it should not be used as a bargaining chip for their release, but they should be punished according to the law. Having dual citizenship is not a problem in itself, many Iranian citizens, including some officials of the Islamic Republic regime, have dual citizenship but have not faced any problems. Some of the detained dual citizens have a history of political or human rights activism that is not favorable to the Islamic Republic. However, it is possible that some of the detained dual citizens do not have a history of political or human rights activism, yet the Islamic Republic sees fit to detain them in order to achieve its goals. In fact, this issue is more influenced by power dynamics and politics rather than legal and judicial aspects. Nevertheless, the Islamic Republic has always claimed that the detained dual citizens have committed crimes and have been treated like other Iranian citizens, but the history of the process of detention, trial, and exchange of dual citizens proves otherwise. The truth is that according to the law, including Article 5 of the Vienna Convention on Consular Relations adopted on December 4, 1353, customary law, and nationality, states

Perhaps if the global community, especially European governments, had not turned a blind eye to the political assassinations committed by the Islamic Republic in their country’s soil in the past, and had shown a more serious and responsible reaction to the various human rights violations in Iran, we would not be witnessing such widespread human rights abuses by the Islamic Republic today. However, we must not forget that human rights are universal and therefore, their violation is not limited to Iran and their consequences affect other countries as well. The writer believes that the international community must condemn and stand against this inhumane atrocity of the Islamic Republic and use all available means to stop it. The necessity of the involvement of the United Nations and its Security Council in this matter seems essential.
