Book Introduction: The Crime of Drinking Wine in Court Proceedings

Last month, we witnessed the poisoning and death of a large number of alcohol consumers in Iran. Reports indicate that the victims were not sure of the standard of the alcohol they consumed, and were generally unaware of the laws related to the crime of “drinking alcohol” in the country.

In this regard, the research group of Cheraq-e Danesh Publications in 1396 (2017-2018) wrote and published a book titled “The Crime of Drinking Alcohol in Court Proceedings” in order to explain the legal issues related to this crime, both for legal researchers and the general audience, as determined by the Islamic Penal Code.

In this book, after introducing the crime of drinking alcohol and a sample report related to it, in the first section titled “The Process of Dealing with a Crime in the Prosecutor’s Office and Court”, several discussions are presented, such as filing a complaint and referring to a competent prosecutor’s office, referring the case to a primary court and setting a date for trial, referring the case to an appellate court and setting a date for trial, and executing the sentence in the local prosecutor’s office where the crime occurred.

In the second chapter, however, this book delves into the elements of the crime of drinking alcohol and examines the legal, material, and spiritual aspects of this crime, presenting an extensive legal discussion in this regard. In the third chapter, the conditions and stages of proving this crime are discussed, and in six discussions, the conditions of being intoxicated, proving the act of drinking alcohol, the punishment for drinking alcohol, the quality of implementing the limit for drinking alcohol, the falling of the limit for drinking alcohol, and the responsibility of the intoxicated person are examined.

After that, this book goes on to discuss the issue of “drinking alcohol in the rulings of the Supreme Court of the country” and in the first section, it examines the opinions of the branches of the Supreme Court in this regard, and reviews these opinions regarding cases such as non-lethal consequences of drinking, participation in mass conflicts leading to murder and injury related to this issue, admission of drinking alcohol, and the discussion of the justification for rejecting property in relation to thefts related to this crime.

In this book, the opinions of the initial and appellate courts are also discussed regarding the issue of alcohol consumption. Titles such as “Not Every Intoxication Leads to Loss of Willpower”, “The Condition of the Insurer’s Return in Third Party Insurance to the Driver Due to Intoxication”, “Handmade Alcoholic Beverages Storage”, “Alcoholic Beverages as a Prelude to Alcohol Consumption”, “Proving Alcohol Consumption through Alcohol Testing”, “Attending Mixed Parties”, “Transporting Alcoholic Beverages as a Prelude to Alcohol Consumption”, etc. are examined from various legal perspectives to fully explain the legislator’s view on this issue in a legal language.

In this book, further discussions such as “repentance as a conditional agreement” and related discussions on forensic medicine and the issue of alcohol consumption are also addressed, allowing interested individuals to become familiar with the legal perspective in Iran in this field. In addition, this book includes various other topics that can be used as a good reference for various legal issues related to the crime of alcohol consumption in the Islamic Penal Code of the Islamic Republic of Iran, and can be used to understand and benefit from them. This is especially important as the legislator has not forgotten even discussions such as the consumption of alcohol by Iranian individuals outside the country.
